Crocs Inc. recently was dealt a blow internationally when a European trademark registry ruled that one of the Niwot-based shoemaker's patents -- protecting its ubiquitous Beach model -- is invalid. The European Union's Office for Harmonization in the Internal Market concluded last month that Crocs' Registered Community Design -- the European Union's equivalent of a patent -- was invalid because it lacked "individual character" compared to prior designs of other holed, foam-like shoes -- notably those of the company that filed the complaint, Canada-based Holey Soles Holdings Ltd.
The decision, made with little fanfare last month, means that Crocs loses its Registered Community Design protection for its Beach model in the European Union.
